Terms and conditions

Bettuh Be LLC ("Bettuh Be", "we", "us", "our") builds, hosts and maintains websites for small businesses. We are based in Barbados and work with clients across the island and abroad.

In this agreement, "you" means the person or business using the service, and "the service" means our websites, the sites we build for you, and everything we do to keep them running.

You need to be at least 16 years old to use Bettuh Be.

You agree to give us accurate, complete and up-to-date information for your account. We may need it to contact you.

Keep your password safe. You are responsible for any activity on your account and for keeping your password confidential, and we are not liable for what happens through your account as a result. If you think your account has been compromised, tell us immediately.

You are free to give us photos, text, audio, video, code and any other material for your site. It stays yours — we do not claim ownership of anything you send us.

You give us the permission we need to use that material for the purpose you sent it: building, hosting, displaying and maintaining your site.

Make sure you own all rights to the content you give us, or otherwise have — and will continue to have — every right and permission needed to legally use, share, display, transfer and license it through the service.

We may show or feature the sites we build on our own website, including on the homepage and in our portfolio.

If you would rather we did not, tell us and we will take it down.

The service depends on other companies: a payment processor for billing, a hosting provider for the servers, an email provider for notifications, and a domain registrar. Your site may also be connected to third-party services at your request.

We do not control any of them and are not responsible or liable for what they do, or for transactions you make with them. Your security when using a third-party service is your responsibility.

We respect intellectual property and ask that you do the same. We respond to notices of alleged infringement case by case, and we reserve the right to disable or delete content alleged to be infringing, and to close accounts that repeatedly infringe.

A paid plan stays in effect until it is cancelled or terminated. You can cancel at any time.

To keep your site running without interruption, we bill your plan automatically each month.

If a payment is not made on time, we reserve the right to suspend your access to the service, and eventually to delete the account.

You can cancel at any time, but cancelling does not entitle you to a refund except at our discretion, or where we are legally required to give one.

We may change our fees. We will give you reasonable notice before we do.

Card payments are handled by a third-party payment processor and are subject to that processor's own terms and privacy policy. We never see or store your full card details. Local bank transfer is available if that is easier.

If you do not already have a domain, we will register and manage one for you at cost. If you already own one, we will connect it at no charge.

A domain we register on your behalf is registered for you, and you can take it with you. If your account ends and we paid for the domain, you may take it over by reimbursing us what it cost.

Renewals are yours to keep paying, through us or directly, once your account with us ends.

Either of us can end this agreement at any time. We reserve the right to change, suspend, discontinue, terminate, restrict or disable your access to part or all of the service or its functionality, at our discretion.

To the fullest extent permitted by law, Bettuh Be, its affiliates and its employees are not liable, for any claim arising out of or related to the service or this agreement, for:

(a) any indirect, special, incidental, exemplary, punitive or consequential damages; (b) any loss of profits, revenue, data, goodwill or other intangible losses; (c) any damages related to your access to, use of, or inability to access or use part or all of your account, your site, or the service, including interruption of use or any change to the service; (d) any damages related to the unavailability, degradation, loss, corruption, theft, unauthorised access to or unauthorised alteration of any content, information or data; (e) the content or conduct of any user or third party using the service, including defamatory, offensive or unlawful content or conduct; or (f) any third-party service or third-party site reached through the service.

Nothing here limits any liability that cannot be limited by law.

To the fullest extent permitted by law, you agree to indemnify and hold harmless Bettuh Be, its affiliates, and their directors, officers, employees and agents against all damages, losses, liabilities, costs, claims, demands, fines, awards and expenses of any kind — including reasonable legal fees — arising out of or related to: (a) your breach of this agreement; (b) your content or your site; (c) any claim by, on behalf of, or against the people who use your site; (d) your breach of any law or regulation, or of the rights or good name of any third party; and (e) any claim from a tax authority in any country relating to your operations, including your sales to consumers.

Before filing a claim against Bettuh Be, you agree to try to work it out informally with us first. Most things can be settled with an email. Bettuh Be LLC is based in Barbados.

We may update these terms. When we do, the effective date at the top of this page changes, and continuing to use the service means you accept the updated terms. If a change is significant, we will tell you.
